Your purchases on UteTheater.com and Utetheater.Simpletix.com (Websites) and at The Ute Theater Box Office (Box Office) are subject to the following terms. Purchases made not at aforementioned sites are subject to the policy of that third-party website, even when purchases are for events held at the Ute Theater and Events Center (Ute Theater).

Event Promoter

The Ute Theater is owned and operated by the City of Rifle. The Ute Theater produces events at the theater and is responsible for the ticket sales, transfers, and refunds, and the event execution, postponement or cancellation.

The Ute Theater is also a venue where third parties (Event Promoters) can reserve the theater and book events. In those cases, the Ute Theater acts as a ticket agent where we are responsible for the sales of a portion or whole of the ticket sales, but the Event Promoter is the responsible party to ticket refunds and transfers. Postponements or cancellation may be executed by The Ute Theater or the Event Promoter.

Sponsorship of an event does not incur event promotion. Please review the specific event for the event promoter’s contact information.

Payment Methods

All ticket prices for events are stated in U.S. Dollars. We accept several methods of payment to accommodate your needs. Major credit cards are accepted on our Website and the Box Office including Visa, MasterCard, American Express and Discover. Cash payments are accepted at the Box Office. All check payments require manager approval before acceptance at the Box Office.

Pricing and Availability

Pricing is determined on an event-by-event basis and determined by many factors. Ticket prices often increase day of show. Visit the event page to view pricing per event. Availability is determined by the arrangement of the house for a specific event. The Ute Theater’s max capacity is 488 people, but most events are set up for 200-300 people. Website ticket sales are scheduled to end a default of 30 minutes before a event’s start time. Occasionally Website sales may be sold out and tickets may still be available at the door. Contact us for the most accurate availability of tickets.

Order Confirmation

If you do not receive a confirmation number (in the form of a confirmation page or email) after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm with the Ute Theater whether or not your order has been placed. Only you may be aware of any problems that may occur during the purchase process. We will not be responsible for losses (monetary or otherwise) if you assume that an order was not placed because you failed to receive confirmation.

Service Fees

Tickets purchased on our Site are typically subject to a per ticket service fee. In some instances, you may be able to purchase tickets directly from the Box Office for a lesser service fee. Service fees are not refundable.

Number of Tickets or “Ticket Limits”

When purchasing tickets on our Website, you are limited to a specified number of tickets for each event (also known as a “ticket limit”). This ticket limit is posted during the purchase process and is verified with every transaction. This policy is in effect to discourage unfair ticket buying practices. We reserve the right to cancel any or all orders and tickets, in addition to prohibiting your ticket purchase abilities, without notice to you, if you exceed or attempt to exceed, the posted ticket limits. Any tickets, cancelled due to violating the posted ticket limit, will be refunded at purchase value (excluding fees). This includes orders associated with the same name, e-mail address, billing address, credit card number or other information.

Ticket Transfer & Resale

Contact us to transfer the name on a ticket. Exchange of funds for ticket transfer is the responsibility of the ticket holder and transferee. Note: We may cancel transferred tickets, at any time, if we determine that they were obtained fraudulently or otherwise in violation of our policies; therefore, it is important that you know and trust the individual transferring tickets to you before accepting them. If an event is canceled or rescheduled, only the original purchaser will be eligible for a refund.

Unlawful resale (or attempted resale), counterfeit or copy of tickets is grounds for seizure and cancellation without compensation. Certain maximum resale premiums and restrictions may apply and we cannot be responsible for providing legal advice regarding resale or pricing of tickets. You are responsible for complying with all applicable ticket resale laws. In addition, we reserve the right to restrict or deny ticket purchasing privileges to anyone that we determine to be, or has been, in violation of our policies. Because we do not guarantee the authenticity of tickets purchased from any non-authorized third party reseller (such as brokers or individuals), we recommend that you purchase tickets directly through our Website, authorized Event Promoters, or from the Box Office to ensure ticket authenticity. Tickets may not be used for advertising, promotions, contests or sweepstakes, unless formal written authorization is given by us.

Opening Acts

Opening acts or guests may sometimes tour with headlining performers. We are not always made aware of opening acts or the length of their performances. Opening acts are subject to change or cancellation at any time without notice. No refund will be owed if an opening act is changed or canceled.

Canceled and Rescheduled Events

Occasionally, events are canceled or postponed. Should this occur, we will attempt to contact you via email to inform you of refund or exchange procedures for that event. For exact instructions on any canceled or postponed events, please check the event information online or contact us.

If an event is canceled, and you purchased your ticket through our Website or Box Office, a refund will be issued within 1 week of the cancellation to the method of payment used to make your purchase. In the case of cash purchases from the Box Office, a check will be mailed to the address provided at time of purchase.

If an event is moved, postponed, or rescheduled, the Event Promoter may set refund limitations. Tickets will automatically be reassigned to the rescheduled date or location and resent to the email address provided at the time of purchase. Reassigned tickets will also be available at the Box Office if we are unable to email you. If you are unable to make the new event date and refunds have been approved by the Event Promoter, please contact us for refund information.

Refunds and Exchanges

Before purchasing tickets, carefully review your event and seat selection. Policies set forth by the Event Promoter may prohibit us from issuing exchanges or refunds after a ticket has been purchased. If exchanges are approved, a per ticket exchange fee may apply. In addition, we may occasionally offer tickets at a discount after the original onsale date and will not refund the difference between the original price and the sale price. Seating maps are representative of a venue’s layout; however, they are subject to change at any time and refunds are not allowed if the map is updated or if additional seats/rows are added or seats change as a result of a venue change after purchase.

You agree that you will not attempt to evade, avoid, or circumvent any refund prohibitions in any manner with regard to tickets you purchased. Without limiting the generality of the foregoing, you will not contact us to seek a refund or exchange from us when we are prohibited from providing one by the Event Promoter, and you will not dispute or otherwise seek a “chargeback” from the company whose credit card you used to purchase tickets from our Website. Should you do so, your tickets are subject to immediate cancellation, and we may, in our sole discretion, refuse to honor pending and future ticket purchases made from all credit card accounts or online accounts on which such chargebacks have been made, and may prohibit future purchases from all persons in whose name the credit card accounts exist and any person who accesses any associated online account or credit card or who otherwise breaches this provision from using our Website.

If we issue you a refund for a ticket due to a canceled or postponed event, we will issue a refund of the ticket’s purchased price paid minus the service fee. If a refund is issued, it will be issued using the same method of payment that was used to purchase the tickets. In the case of cash purchases from the Box Office, a check will be mailed to the address provided at time of purchase. We will not be liable for travel or any other expenses that you or anyone else incurs in connection with a canceled or postponed event.

Order and Billing Information Verification

All information on orders must be valid and are subject to verification. Orders that are placed, or attempted to be placed, using any information that is found to be false, misleading, incorrect, incomplete or cannot be verified as belonging to the ticket holder, such as name, address, email address, phone number, or other, are subject to cancellation, at any time. Furthermore, we may cancel your order and sell your tickets to another customer without further notice. Orders are subject to credit card approval and processed only after the billing address, associated with your credit card, and other billing information, has been verified.

Delivery Options

Generally, the following delivery methods are offered:

  • Mobile – For tickets purchased on our Website, enter your phone number and click “Send eTickets Via Text Msg” at checkout. Mobile ticket delivery is also available at the Box Office. We can scan your ticket(s) directly from your mobile device to check-in at the door.
  • Print-at-Home – All tickets are emailed to ticket holders whether purchased at the Box Office or on our Website as long as an email address is provided. Ticket holders can print the attachment at home, or bring the email on a mobile device to check-in.
  • Will Call – Our ticket system allows us to look up your ticket at the door by name of the ticket purchases. Please present a valid, state issued ID at the time of check-in.
  • Delivery – No mailing options are offered by default. If you require physical tickets to be mailed, please contact us. Delivery fees may apply.

Multiple Browser Windows

When ordering tickets online with us, please ensure you are looking for tickets and placing an order using only one browser window. Looking up tickets using multiple browser windows could result in losing your tickets, errors occurring during the purchase process, or timer expiration.

Limitation of Liability

You voluntarily assume all risks and danger incidental to the event for which the ticket is issued, whether occurring before, during or after the event, and you waive any claims for personal injury or death against us, management, facilities, leagues, artists, other participants, and all of our respective parents, affiliated entities, agents, officers, directors, owners and employees on behalf of yourself and any accompanying minor. You bear all risks of inclement weather. Event date and time are subject to change.

Ejection and Refusal; No Redemption Value

Event Promoters reserve the right, without refund of any amount paid, to refuse admission, or eject, any person whose conduct management deems disorderly, who uses vulgar or abusive language, or who fails to comply with theater rules. Breach of rules will terminate your license to attend the event without refund. A ticket is a revocable license and admission may be refused with or without refunding the ticket’s purchased amount minus fees. A ticket is not redeemable for cash.

Recording, Transmission and Exhibition

You agree that the event for which you purchase tickets is a public event, that your appearance and actions inside and outside the theater where the event occurs are public in nature, and that you have no expectation of privacy with regard to your actions or conduct at the event. You grant permission to us, the Event Promoter(s), our partners, licensees and assigns, including but not limited to our brand and media partners, to utilize your name, image, likeness, acts, poses, plays, appearance, movements, and statements in any live or recorded audio, video, or photographic display or other transmission, exhibition, publication or reproduction made of, or at, the event (regardless of whether before, during or after play or performance) for any purpose, in any manner, in any medium or context now known or hereafter developed, without further authorization from, or compensation to, you or anyone acting on your behalf.

You Are Subject to Search

You and your belongings may be searched on entry to the event. You consent to such searches and waive any related claims that may arise. If you elect not to consent to such searches, you may be denied entry to the event without refund or other compensation. Under certain facility rules, certain items may not be brought into the premises, including without limitation, firearms, alcohol, drugs, controlled substances, drones, recording devices, laser pointers, strobe lights, irritants (e.g., artificial noisemakers), and outside beverages.
